For the purposes of these Terms and Conditions "We", "Our" and "Us" refers to Letitia General Trading LLC. Please review these Terms and Conditions carefully before using this Site. Your use of this Site indicates your irrevocable agreement 

to be bound by these Terms and Conditions (as may be amended by us from time to time). If you do not agree to be bound by these Terms and Conditions please stop accessing and using this Site immediately.

This Site is intended only for your personal, non-commercial use. Unless otherwise specified, you alone are solely responsible for determining whether any feature of this Site is appropriate or suitable for your requirements.

 

We may, at Our sole discretion, impose limits or restrictions on the use you may make of the Site. Further, for security, technical, maintenance, legal or regulatory reasons, or due to any breach of these Terms of Use, We may withdraw the Site 

or your access to the Site, at any time and without notice to you. We may update the Website and any of their content at any time, and we make no guarantees that the Website, or any of their Content, are accurate, true or complete.

1. Copyright in Content

 

Content in which Letitia owns copyright (or related rights) may be downloaded and used free of charge but subject always to these Terms of Use. The permission

granted by these Terms of Use is for "non-commercial" use of the Content only (meaning any use that is not intended for or directed towards commercial advantage or private monetary compensation).

2. Non-commercial use of Content

 

The following "non-commercial" uses are the only uses permitted by these Terms of Use:

 

 For personal use: this means the one-time use of Content by one person for non-commercial research and private study.

 For educational use: this means the one-time use of Content by a student at an Educational Establishment (defined below) for use in course-related academic materials, for the purpose of securing a degree or other academic qualification.

 For print-based academic publications: this means the one-time use of Content (ie for one edition only) for a printed publication by an academic publisher with a print-run of up to and including 4,000 copies.

 For use by charities and other non-profit organisations: Reproduction of Content in print or electronic formats for circulation to members or 'friends', with a print-run of up to and including 5,000 copies or for up to 6 years for online use.

 

However, please note that the following additional terms and conditions apply to each non-commercial use of Content described above:

 

 "Educational Establishment" means bodies and institutions engaged in the provision or support of education, learning, teaching and research, or any combination of them.

 "High Resolution Images" means up to 2,500 pixels along the longest side of the image (300 dpi).

 "Low Resolution Images" means up to and including 768 pixels along the longest side of the image (72 dpi).

 "Editorial Text" means any Letitia owned editorial text on the Website in which the Letitia asserts copyright.

 "Descriptive Text" means basic caption information relating to images on Search the Collections web pages in which the Letitia does not assert copyright.

 

The permissions granted in these Terms of Use are for inside publication use only: The use of Content on external covers of publications (or for any pages of a publication which are used to market the publication for distribution, publicity or sale) is subject to other commercial terms.

• High Resolution Images must not be printed any larger than A5 size.

• High Resolution Images may be reasonably cropped and resized but must not be altered in any other way.

• The amount of Letitia Content used must not exceed 25% of the total content used in your publication or project.

 

You may re-produce excerpts of Editorial Text for a non-commercial purpose on the condition that you acknowledge the Letitia’s authorship of such text in the form of the Credit line stated in clause 3 below. You may re-produce excerpts of Descriptive Text for a non-commercial purpose without acknowledging the

Letitia’s authorship provided that you comply with the other restrictions of this clause 2.

 

3. Crediting

You must ensure that any use of Content is credited as follows, unless otherwise stated: © Letitia General Trading LLC, Dubai. This credit line represents the 'Trustees of Letitia General Trading LLC’.

You may not use the Letitia logo without permission from our Licensing Team. The Letitia brand (including the Letitia’s name and logo) may not be used to suggest any endorsement or approval by the Letitia of your use of Letitia Content. 

 

4. Third Party Content

 The Letitia has attempted to identify any Content in which a third party owns copyright ("Third Party Content"), and to secure permission for its use only by the Letitia. Therefore, it is your responsibility to secure any permission or

 5. Liability

To the extent permitted by law, the Letitia excludes all conditions, warranties, representations or other terms, which may apply to the Website or any Content, whether express or implied. We will not be liable to any user for any loss or

 damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with your use of, or inability to use, our Websites or your use of or reliance on any Content,

PROVIDED THAT nothing in these Terms of Use shall restrict or exclude any liability that the Letitia has to any party which cannot be excluded by law.

 

The Letitia assumes no responsibility for the content of websites linked to or from the Website. Such links should not be interpreted as endorsement by the Letitia of those linked websites and the Letitia shall not be liable for any loss or damage that may arise from your use of them.

 

 

6. Breach of these Terms of Use

 The Letitia keeps electronic records of all High Resolution Images downloaded from the Website. In the event of any identified breach of these Terms of Use (involving the misuse of High Resolution Images or otherwise), the Letitia

(and/or its affiliates) may take appropriate action to constrain further use and/or to seek financial recompense.

 

7. No Waiver

 No failure by the Letitia to exercise or enforce any of its rights under these Terms of Use will be deemed to be a waiver of such rights or a bar to their exercise or enforcement in the future.

 

8. Data Protection

The Letitia will keep a record of any information you provide about yourself and your downloaded content for rights management and enforcement purposes, but except for such purposes, will not provide that information to any third party

and will otherwise comply with all applicable laws (including the Data Protection Law 2007).

 

9. Law and Jurisdiction

These Terms of Use are governed by federal laws of the United Arab Emirates applicable in the Emirate of Dubai and the laws of the Emirate of Dubai shall have jurisdiction over any dispute arising from them.

1. Terms of use when submitting contributions to the Letitia website

 

Things you are giving the Letitia when you upload content:

 When you submit your contributions to the Letitia website, you are granting the Letitia, free of charge, permission to use the material in any way it wants.

 You are granting the Letitia and its subsidiaries an irrevocable, non-exclusive, royalty free, perpetual and worldwide license to reproduce your contribution in any medium and to publish such reproductions in Gallery publications including but not limited to catalogues, visitor

leaflets, exhibition-related materials, exhibition advertising, in-gallery displays (including electronic and screen-based displays), internal management systems, on the Gallery website and on other websites to which the Gallery contributes material where the items are made available on a non-commercial basis and/or

to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in the Letitia’s Privacy Policy.

 You are also granting the Gallery the right to give members of the public a copy of your content for the purpose of private study or educational activities or research.

Things to consider before uploading your content:

 When you contribute your content, you are confirming that your contribution is your own original work and that you are fully entitled to grant to the Letitia non-exclusive rights to use it. You should not violate, plagiarise, or infringe the rights of any third parties including copyright,

trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

 You agree that your content is in no way defamatory, illegal or offensive.

 

The Letitia reserves the right to remove any content that it deems unsuitable. This will include content that is unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable.

 

 You also agree that you have the consent of anyone who is identifiable in your content or the consent of a parent or guardian if the person is under 16 years of age.

 You should not submit any content that is intended to advertise or promote a business. The Letitia reserves the right to remove any content deemed to be advertising material.

 

How we will handle your content:

 

The Letitia reserves the right to use none, part or all of your submission and may delete any contribution published onto its website at any time.

If you do not want to grant to the Letitia the above rights or cannot provide the warranties set out above, please do not submit your contribution.

 

Your use of this Site and the operation of these Terms and Conditions shall be governed by and construed in accordance with the federal laws of the United Arab Emirates applicable in the Emirate of Dubai and the laws of the Emirate of Dubai.

You agree, acknowledge, and submit to the Courts of Dubai having non- exclusive jurisdiction over all and any dispute or difference between us arising out of or in connection with this Agreement.
